“Duh, Winning” Coming to a Trademark Office Near You

Since his firing from the hit show Two and a Half Men, Charlie Sheen has been ranting and coming out with a lot of different phrases that, because of the internet, are becoming part of the lexicon. But he wants to be the first to make sure that he has the rights to sell them on merchandise including t-shirt, mugs, drinks, etc. His associates handling the process have filed 22 different trademarks with the office, everything from “Duh, Winning” to “Rock Star From Mars.”

The trademark process, being managed by a California company that has filed for Sheen, can take more than a year and multiple people are trying to get rights to the phrases besides Sheen, including Jimmy Buffett of Margaritaville fame. Buffett wants to use “Tiger Blood” for a new type of alcohol drink, no doubt for use in his restaurants. “Adonis DNA” was trademarked before Charlie’s group could get to the registration and may be the single one with an issue, since at least one was filed before Sheen even used the phrase.

However, it’s not always a race in trademark grants. The decision to grant a mark is often based on who has been actively using the mark in products and services before registering it. Since Charlie has already been selling T-Shirts with a lot of the phrases and the fact that they were coined in public will certainly give him an advantage against his competitors. His legal team, which is helping in handling the submissions, is confident that Charlie will prevail in the end. And they are so confident, that they are going forth with many opportunities even before securing the proper protections.

Sheen isn’t stopping at popular catch phrases though. His name, Sheen’s Goddesses (what he calls his girlfriends) and the name of his house, Sober Valley Lodge, are also being registered. It should be interesting to see what he is granted. Whatever it is will no doubt wind up in a merchandising frenzy with these things appearing on who knows what.
